Effective date: 11 September 2026 Last updated: 11 September 2026 App: Gym Tross (iOS and Android) Developer: D. Raj Gurung (“we,” “us,” “our”) Contact: divy5831@gmail.com
These Terms of Service (“Terms”) govern your access to and use of Gym Tross, the mobile application for iOS and Android (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
If you obtained the App from the Apple App Store, it is also subject to Apple’s Licensed Application End User License Agreement (“Apple EULA”). In the event of any conflict between these Terms and the Apple EULA, the Apple EULA controls, except where these Terms are stricter or provide additional protections, in which case these Terms apply.
Gym Tross is the mobile companion to a gym management service. It is used by gym staff to register members, check members in, record payments, and log walk-in visitors, and by gym members to view their own membership.
The App is not sold to the public. Access is granted by a gym that holds an account with us. You use the App either as a member of that gym’s staff or as one of its members, in the role that gym assigns you.
You must be at least 16 years old to hold an account of your own. By using the App you represent that you meet this age requirement and that the gym that issued your account has authorised your use.
A gym may hold a record for a junior member; that record is controlled by the gym, which is responsible for obtaining any parental or guardian consent its local law requires.
Accounts are created by the gym, not by you. You may not create an account for yourself, share your credentials, or use another person’s account.
You are responsible for keeping your password confidential and for everything done under your account. Tell your gym and us immediately if you believe your account has been used without your permission.
Your gym may change your role, move you between branches, suspend your access, or remove your account at any time. We may suspend or terminate access where use breaches these Terms or where the gym’s own account ends.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App on a device you own or control, solely for the purpose your gym granted you access for.
All rights not expressly granted to you are reserved by us.
The App, including all source code, design, graphics, text, logos, icons, databases, and arrangement thereof, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property rights to you.
Member records, attendance, payments, and every other operational record created in the App belong to the gym, not to us and not to the individual who typed them in. We do not claim ownership of them and we do not use them for any purpose other than running the service for that gym.
You are responsible for what you enter. Specifically, you agree to:
How personal information is handled is described in the Privacy Policy. The gym is the controller of the data in its workspace; we act as its processor.
You agree not to:
The App records money; it does not move it. Fees, membership prices, discounts, refunds, and the collection of cash or digital payments are entirely a matter between the member and the gym. We are not a party to that transaction, we do not process payments, and we hold no funds.
Any dispute about a fee, a refund, or an amount recorded in the App must be raised with the gym.
We aim to keep the service available but do not guarantee uninterrupted operation. The service may be unavailable during maintenance, or because of a failure at an infrastructure provider, a network outage, or an event outside our control. Features may be added, changed, or removed.
To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
The App is an administrative tool. It is not a medical, safety, or accounting product. It does not give fitness, medical, legal, tax, or accounting advice, and its records are not a substitute for the gym’s own statutory bookkeeping obligations.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, goodwill, or data, arising out of or related to your use of the App.
Our total aggregate liability arising out of or related to the App is limited to the amount the gym paid us for the service in the twelve months preceding the event giving rise to the claim, or NPR 5,000, whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold us harmless from any claim, loss, or expense arising from your breach of these Terms, your misuse of the App, or your unlawful handling of another person’s information through it.
The App relies on Supabase for database, storage, and authentication, and on the Apple App Store and Google Play for distribution. Their terms apply to their own services. We are not responsible for them.
Apple and Google are not parties to these Terms, have no obligation to provide support for the App, and, where the App was obtained from their store, are third-party beneficiaries entitled to enforce these Terms against you.
We may update these Terms. When we do, we will update the “Last updated” date above. Material changes will be communicated to gym account owners by email. Continuing to use the App after a change takes effect means you accept the revised Terms.
These Terms are governed by the laws of Nepal, without regard to conflict-of-law rules. The courts of Kathmandu, Nepal have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings locally.
